Right to Rent Checks Explained: The Documents You Actually Need

One legal check stands between you and your keys. Here's how to pass it in five minutes.

Before any tenancy in England begins, the landlord is legally required to check that every adult tenant has the right to rent in the UK — it's their obligation under the Immigration Act, with real fines if they skip it. For you, it's a five-minute document exercise, as long as you know which five minutes. Here's the whole thing, demystified.

What the Check Actually Is

The landlord (or agent, or co-living operator) verifies your identity and immigration status before you move in, and keeps a copy on file. It applies to every adult who'll live in the property — British citizens included. It is not a credit check, not a visa application, and not something that goes on any record of yours; it's the landlord proving their own compliance.

Which Route Applies to You

British and Irish citizens: your passport (current, or expired is accepted). No passport? Combinations like a UK birth certificate plus an official letter work — the landlord has a government list of acceptable pairs.

Everyone else — the share code route: if you have a visa, pre-settled/settled status, or a biometric residence permit, you prove status online. Go to the government's "prove your right to rent" service, log in, and generate a share code (starts with R) — give that code plus your date of birth to the landlord, who checks it on the official site. Codes last 90 days and generating a fresh one takes two minutes. Students: your student visa carries the right to rent — the share code is how you show it.

Booking from abroad? The check must be completed before move-in, not before booking. Reserve the room remotely, then do the check at key handover or online just before — standard practice for international arrivals, and covered in the renting-from-abroad guide.

Your Rights in the Process

The landlord may copy your documents but must store them securely and use them only for this check (UK GDPR applies). They cannot charge you for the check — it's their legal duty, and check fees are banned tenant fees. And they must apply the check to all applicants equally: someone running checks only on people who "sound foreign" is breaking discrimination law, not following it.

The Red Flags (Both Directions)
